Terms of Service

1. Who we are and what this covers

Visibility OS is a software service operated by Garage Productions Private Limited ("we", "us"). It lets you track how AI assistants such as ChatGPT, Gemini, Claude, Perplexity and Grok mention your brand. These terms are a binding agreement between you (or the organisation you represent) and us. By creating an account or using the service you accept them.

If you use the service for an organisation, you confirm you have authority to bind it. The service is meant for business use, and you must be at least 18 years old and capable of entering a contract under the Indian Contract Act, 1872.

2. Your account

• Give accurate information and keep your login secure. You are responsible for activity under your account.
• Owners and admins of a workspace decide who else has access and at what role.
• Tell us promptly if you suspect unauthorised access.

3. The service and how checks work

A check sends the prompt text you have chosen to an AI provider through that provider's official API and stores the answer, so we can measure mentions, position, sentiment, citations and competitors. AI answers vary between runs, models and locations, so results are a measurement of what those systems said at that time. They are not a guarantee of how any AI system will describe your brand in future.

We may change, improve or remove features. Where a change materially reduces what a paid plan includes, we will give reasonable notice.

4. Plans, limits and payment

• Each plan has limits on brands, prompts and engines. Limits are enforced by the service and shown on the billing page.
• Fees are quoted in US dollars and are exclusive of applicable taxes. GST is added where required by law and shown on your invoice, which carries our GSTIN.
• Subscriptions are currently arranged with our team and invoiced or recorded manually. Your plan stays active for the period you have paid for.
• If a payment is overdue we allow a grace period of 7 days, after which the workspace moves to the free plan. Your data is not deleted because of a lapse, but limits of the free plan apply and content above them may become read-only.
• Fees already paid are non-refundable unless the law requires otherwise or we agree in writing.

5. Free trial

The free trial gives limited access (one brand, five prompts and one engine, no card required). We may change or end trials for a workspace that abuses them.

6. Your data and content

You keep ownership of your brand information, prompts and the data you put in. You give us a limited licence to host, process and display it, and to send prompts to the AI providers you have selected, only to provide the service to you.

You must have the right to use anything you submit, and you must not submit personal data of individuals as prompt text unless you have a lawful basis to do so.

7. Acceptable use

You agree not to:

• break the law or infringe anyone's rights;
• probe, scan or test the vulnerability of the service, or bypass its limits, rate limits or access controls;
• resell or offer the service to third parties as a competing product, except as an agency running checks for your own clients under a plan that allows it;
• use automated means to place load on the service beyond normal use, or to scrape it;
• submit malicious code, or content that is unlawful, defamatory or harmful.

8. Suspension and termination

You can stop using the service and delete your account at any time from Workspace settings. We may suspend or end access if you breach these terms, if payment is not made, or if required by law, and we will tell you why when we reasonably can.

When an account ends, your right to use the service ends. Sections that by nature should survive (ownership, liability, governing law) continue.

9. Third-party AI providers

The service depends on third-party AI providers (see the sub-processor list in our DPA). We do not control them, and their availability, pricing and outputs can change. Their own terms apply to the requests we send on your behalf. If a provider is unavailable, checks may fail or be delayed, and no usage is charged to you for checks that did not run.

10. Disclaimers

The service is provided "as is" and "as available". To the extent permitted by law we do not promise that it will be uninterrupted or error-free, or that AI outputs are accurate, complete or suitable for a particular decision. You are responsible for how you use the insights.

11. Limitation of liability

To the extent permitted by law, we are not liable for indirect, incidental or consequential loss, or for loss of profit, revenue or goodwill. Our total liability arising out of the service in any 12-month period is limited to the fees you paid us for that period (or INR 10,000 equivalent if you are on a free plan). Nothing in these terms limits liability that cannot be limited by law.

12. Indemnity

You will indemnify us against third-party claims arising from your breach of these terms or from content you submit in breach of them.

13. Changes to these terms

We may update these terms. For material changes we will notify you in the app or by email before they apply. Continuing to use the service after that means you accept the updated terms.

14. Governing law and disputes

These terms are governed by the laws of India. The courts in Noida, Uttar Pradesh have exclusive jurisdiction, subject to any mandatory rights you have. We would like to resolve disagreements amicably first, so please write to us before starting formal proceedings.
